Passaic Municipal Court DUI Cases

The Passaic Municipal Court sits at 330 Passaic Street, Passaic, NJ 07055. The court code is 1607. All DUI cases that start in the city are heard here. When a driver is charged under N.J.S.A. 39:4-50, the complaint is filed at this court and a case file is created. That file holds the police report, BAC test results, and the final ruling.

Court hours run Monday through Friday from 9 AM to 3:30 PM. Sessions are held on weekdays at 9 AM, with additional sessions at 1:30 PM on Monday, Tuesday, and Thursday. DWI cases in Passaic are scheduled for Monday and Tuesday at 5:00 PM. Call 973-365-3975 to check on a case or get the next court date.

DUI is a traffic offense in New Jersey, not a criminal charge. Cases stay at the municipal court level unless linked to a more serious offense. Most Passaic DUI records are found at this court.

Searching Passaic DUI Records Online

The state runs a free tool that lets you look up municipal court cases from across New Jersey. The Municipal Court Case Search covers Passaic and all other municipal courts. You can search by name, case number, or complaint number. Select Passaic from the court list to narrow the results.

The search results show the charge, case status, and court date. This is the fastest way to check on a Passaic DUI case from home. Not all older cases show up online, though. For records more than a few years old, call the court at 973-365-3975.

The NJ Courts Find a Case page gives you a second option. It searches across both municipal and Superior Court records statewide. Use it when the municipal tool does not give you a result.

To run a search, you will need the full name of the person and the approximate date of the charge. A ticket or complaint number speeds up the process if you have one.

Passaic DUI Arrest Records

The Passaic Police Department handles DUI arrests in the city. During a stop, the officer may run field sobriety tests and a breath test. If the driver fails or refuses, the officer makes an arrest and writes a report. That report includes the date, time, place, charges, and BAC reading if one was taken.

You can request these records through the Open Public Records Act. File an OPRA request in writing with the Passaic Police Department. Include the name of the person, the date, and the type of record you want. The city must respond within seven business days.

There may be a small fee for copies. Some parts of the report could be redacted under OPRA exemptions.

DUI Penalties Applied in Passaic

Passaic courts apply the same DUI penalties as every other court in New Jersey. State law under N.J.S.A. 39:4-50 sets the fines, jail time, and license consequences based on the number of offenses and the BAC level. The legal limit is 0.08% for drivers 21 and over.

A first DUI offense with a BAC of 0.08% to 0.10% carries fines of $250 to $400, up to 30 days in jail, and mandatory time at the Intoxicated Driver Resource Center. The MVC suspends the license and requires an ignition interlock device. See the full chart on the NJ MVC DUI penalties page.

Higher BAC levels bring bigger fines and longer suspensions. Repeat offenses add mandatory jail time. Refusal to take a breath test is a separate charge under N.J.S.A. 39:4-50.4a with its own set of penalties.

All penalty details are part of the Passaic DUI record once the court enters a sentence.

Passaic County Superior Court Records

The county court system also handles appeals from the municipal court. If a DUI conviction in Passaic is challenged, the appeal goes to the Superior Court for review.

Only a small share of DUI cases reach this level. Most are resolved in the Passaic Municipal Court.

DUI Records and Driving History

A DUI conviction in Passaic goes on your driving record with the New Jersey Motor Vehicle Commission. This is a separate record from the court file. The MVC tracks license status, points, suspensions, and all DUI convictions. Order your own history through the MVC driver history page.

DUI stays on a New Jersey driving record for life. It does not drop off after a set number of years. This is one reason Passaic DUI records have lasting weight well beyond the court date.

New Jersey does not allow expungement of DUI convictions. Because DUI falls under Title 39 and not the criminal code, the expungement statute does not cover it. A conviction in Passaic is permanent.

What Passaic DUI Records Contain

Passaic DUI records hold the facts of the case from start to finish. The exact contents depend on the source, but most records share a core set of details.

A court record for a DUI case in Passaic typically lists:

  • Name and date of birth of the driver
  • Date and location of the stop or arrest
  • BAC reading or refusal note
  • Charge filed under N.J.S.A. 39:4-50
  • Court dates, plea, and final outcome
  • Sentence including fines and license suspension

Police reports add context that the court file may not have. They describe what the officer saw, why the stop was made, and what tests were given. You may need to pull from both the court and the police department to get a full picture of a Passaic DUI case.
